## What Do Nonprofits Need From Fiduciary Liability Insurance?

Start with your plan's ERISA status. The IRS says 403(b) plans are offered by public schools and certain 501(c)(3) organizations and work like a 401(k). Plans that are subject to ERISA must meet fiduciary obligations, while governmental plans, non-electing church plans and other 403(b) plans that meet the Department of Labor's safe-harbor requirements are not subject to ERISA. The people who run the plan are the fiduciaries. The Department of Labor says that where an employer uses an internal administrative committee or HR department, the officials with discretion over the plan are its fiduciaries, and that all fiduciaries have potential liability for their co-fiduciaries' actions, for example if they knowingly take part in a breach, conceal it, or fail to correct it. ERISA makes a fiduciary who breaches their duties personally liable to make good the plan's losses. ## Which Fiduciary Liability Exposures Do Nonprofits Face?

Most claims are about process, not misconduct. One insurer lists excessive-fee suits, imprudent investment selection, failure to monitor fees and performance, plan-interpretation disputes and fee-disclosure failures as common claim types, and says many turn on whether fiduciaries documented how they selected and monitored investments.
