# Best Employment Practices Liability Insurance for Startups (2026)

Coverage line: Employment Practices Liability Insurance. Buyer segment: Startups. Providers ranked: 5.

## Quick Answer

Startups can face employment claims before they have an HR function: applicants can bring them, federal law reaches you at 15 employees and some states sooner. Check how the policy treats wage-and-hour and contractor-classification disputes, layoffs, a financing that changes your board, and a change of carrier. ## How Did Spot Rank Employment Practices Liability for Startups?

Spot lists a provider only when its published Employment Practices Liability Insurance information includes a documented claim (verified or company-reported) about eligibility, role, coverage or application that mentions startups. “Named for Startups” marks a provider’s own statement of who it serves; “Related mention” marks a role, coverage or application claim.

Providers with both a Spot Score and a Review Score rank first, then providers with one of the two, then providers with neither. Within each group the order is the equal-weight average of the scores the provider has, as in the industry guides; ties break on fit, then the number of documented claims, then name.

The Spot Score comes from Spot’s reliability assessments and the Review Score from the provider’s rated review sources. Neither measures whether a policy fits your business or what it costs.

Spot, a product of Tools for Enlightenment, publishes this research and works in the commercial insurance market. [Editorial policy](https://spot.insure/editorial-policy).

## What Do Startups Need From Employment Practices Liability Insurance?

Know when the law reaches you. The EEOC says federal anti-discrimination laws cover employers with 15 or more employees, or 20 for age discrimination. Its manual counts 15 employees on each working day in 20 or more calendar weeks, and says a newly formed company is covered if it meets that test during the rest of the same calendar year. Some states start lower: California's civil rights department puts discrimination rules at five employees and prohibits harassment in every workplace, and New York's human rights division says its law covers every employer regardless of size. [1](https://www.eeoc.gov/publications/get-facts-series-small-business-information "Get the Facts Series: Small Business Information") [2](https://www.eeoc.gov/laws/guidance/section-2-threshold-issues "Section 2 Threshold Issues (EEOC Compliance Manual)") [5](https://calcivilrights.ca.gov/employment/ "Employment") [6](https://dhr.ny.gov/protected-places "Protected Places")

A claim can come from someone you never hired. The EEOC says it is illegal to discriminate against a job applicant, and a carrier's specimen policy defines a claimant to include an applicant for employment and discrimination to include a failure or refusal to hire. The Insurance Information Institute adds that small businesses are less likely to keep employment attorneys or detailed policies and training programs. [3](https://www.eeoc.gov/prohibited-employment-policiespractices "Prohibited Employment Policies/Practices") [9](https://asset.trvstatic.com/download/assets/epl-3001.pdf/2c354eaa63ca11eeacdd06e978c86228 "Employment Practices Liability Coverage (EPL-3001 Ed. 01-09, specimen)") [12](https://www.iii.org/article/employment-practices-liability-insurance "Employment practices liability insurance")

## Which Employment Exposures Do Startups Face?

Contractor labels are tested on the facts. The IRS says no one factor decides and that a remote worker is your employee if you can control what is done and how. In a carrier's specimen, the wage-and-hour exclusion keeps out claims under wage and hour law, with exceptions for retaliation and the Equal Pay Act, and that law is defined to include the classification of employees for the purpose of determining their eligibility for compensation. Ask whether a dispute over whether a contractor was really an employee falls inside that exclusion. [7](https://www.irs.gov/businesses/small-businesses-self-employed/independent-contractor-self-employed-or-employee "Independent contractor (self-employed) or employee?") [9](https://asset.trvstatic.com/download/assets/epl-3001.pdf/2c354eaa63ca11eeacdd06e978c86228 "Employment Practices Liability Coverage (EPL-3001 Ed. 01-09, specimen)") [10](https://asset.trvstatic.com/download/assets/lia-3001.pdf/e79a6b6c63ca11eeaa7806e978c86228 "Liability Coverage Terms and Conditions (LIA-3001 Ed. 01-09, specimen)")

Layoffs draw attention from the law and from underwriters. The EEOC says an employer may not choose the oldest workers for layoff because of their age or discriminate when deciding who to recall. One carrier's application asks how many employees were laid off in the past 12 months and whether layoffs are expected in the next 12, with an explanation attached. The specimen excludes federal WARN Act claims, which apply to employers with 100 or more employees. [3](https://www.eeoc.gov/prohibited-employment-policiespractices "Prohibited Employment Policies/Practices") [8](https://www.ecfr.gov/current/title-20/chapter-V/part-639/section-639.3 "20 CFR 639.3 Definitions") [9](https://asset.trvstatic.com/download/assets/epl-3001.pdf/2c354eaa63ca11eeacdd06e978c86228 "Employment Practices Liability Coverage (EPL-3001 Ed. 01-09, specimen)") [11](https://asset.trvstatic.com/download/assets/epl-n-14100.pdf/2d8b7a7c63ca11eeba389e98f6b6ed6a "Employment Practices Liability Coverage Application (EPL-N-14100 Ed. 06-22)")

A financing can change the policy. In one carrier's specimen terms, a change of control includes someone obtaining the right to elect, appoint or designate more than 50% of the board, and after it coverage ceases for wrongful acts committed afterward. Whether an investor's board seat triggers that depends on the wording, so ask before you close a round. [10](https://asset.trvstatic.com/download/assets/lia-3001.pdf/e79a6b6c63ca11eeaa7806e978c86228 "Liability Coverage Terms and Conditions (LIA-3001 Ed. 01-09, specimen)")

## What Should Startups Check Before Buying Employment Practices Liability Insurance?

Match the territory to where your people work. One startup insurer's policy applies to claims made and pursued in the United States, its territories, Puerto Rico or Canada and tells startups with international employees to discuss the limit; a carrier's specimen terms apply to wrongful acts and claims anywhere in the world. A carrier's application asks for headcount in California and Illinois and outside the United States, so list remote staff by location. [10](https://asset.trvstatic.com/download/assets/lia-3001.pdf/e79a6b6c63ca11eeaa7806e978c86228 "Liability Coverage Terms and Conditions (LIA-3001 Ed. 01-09, specimen)") [11](https://asset.trvstatic.com/download/assets/epl-n-14100.pdf/2d8b7a7c63ca11eeba389e98f6b6ed6a "Employment Practices Liability Coverage Application (EPL-N-14100 Ed. 06-22)") [14](https://www.corgi.insure/employment-practices-liability "Employment Practices Liability")

Ask what happens to claims when you change policies. Most EPLI is claims-made, which the Insurance Information Institute says is why a retroactive date matters: it can allow coverage for an incident before the policy started. A carrier's specimen excludes matters pending or known before dates set in its declarations. The EEOC allows charges within 180 days, or 300 where state or local law also applies, so an act can surface months later. One carrier's application asks for the date coverage was first bought if under three years and for EEOC charges in the past three years, and one insurer's private-company form adds continuity protection for an EEOC charge or written demand begun under a prior EPL policy, with conditions. [1](https://www.eeoc.gov/publications/get-facts-series-small-business-information "Get the Facts Series: Small Business Information") [9](https://asset.trvstatic.com/download/assets/epl-3001.pdf/2c354eaa63ca11eeacdd06e978c86228 "Employment Practices Liability Coverage (EPL-3001 Ed. 01-09, specimen)") [11](https://asset.trvstatic.com/download/assets/epl-n-14100.pdf/2d8b7a7c63ca11eeba389e98f6b6ed6a "Employment Practices Liability Coverage Application (EPL-N-14100 Ed. 06-22)") [12](https://www.iii.org/article/employment-practices-liability-insurance "Employment practices liability insurance") [13](https://insurance.archgroup.com/wp-content/uploads/sites/2/ArchCanopy2_Playbook-1.pdf "Arch Corporate Canopy 2.0 playbook and policy form (PCD0700 00 07 22)")

If EPL comes in a bundle, check the limit. One insurer sells directors and officers and employment practices cover as parts of one private-company policy with an option to share a single limit, and a carrier's specimen is marked as claims-made with defense expenses included in the limit. Ask whether your EPL limit is shared and whether defense costs reduce it. [9](https://asset.trvstatic.com/download/assets/epl-3001.pdf/2c354eaa63ca11eeacdd06e978c86228 "Employment Practices Liability Coverage (EPL-3001 Ed. 01-09, specimen)") [13](https://insurance.archgroup.com/wp-content/uploads/sites/2/ArchCanopy2_Playbook-1.pdf "Arch Corporate Canopy 2.0 playbook and policy form (PCD0700 00 07 22)")

Have your people practices in writing. The Insurance Information Institute advises written workplace policies in a handbook, and the EEOC says employers should work to prevent and correct harassment through a complaint process, training and prompt action. One carrier's application asks whether you have a handbook and whether you consult employment counsel before terminations. [4](https://www.eeoc.gov/harassment "Harassment") [11](https://asset.trvstatic.com/download/assets/epl-n-14100.pdf/2d8b7a7c63ca11eeba389e98f6b6ed6a "Employment Practices Liability Coverage Application (EPL-N-14100 Ed. 06-22)") [12](https://www.iii.org/article/employment-practices-liability-insurance "Employment practices liability insurance")

## What Do Startups Ask About Employment Practices Liability Insurance?

### Do Startups Need Employment Practices Liability Insurance Before They Reach 15 Employees?

The 15-employee line is only the federal one. The EEOC counts 20 calendar weeks in the current or prior year, so a growing company can be covered mid-year, and California and New York reach smaller employers. [1](https://www.eeoc.gov/publications/get-facts-series-small-business-information "Get the Facts Series: Small Business Information") [2](https://www.eeoc.gov/laws/guidance/section-2-threshold-issues "Section 2 Threshold Issues (EEOC Compliance Manual)") [5](https://calcivilrights.ca.gov/employment/ "Employment") [6](https://dhr.ny.gov/protected-places "Protected Places")

### Does Employment Practices Liability Insurance Cover Wage and Hour Claims for Startups?

Sometimes not. A carrier's specimen excludes wage and hour claims except retaliation and Equal Pay Act claims, and defines wage and hour law to include classifying employees. One insurer's private-company form offers an optional defense-cost sublimit for them. Ask how your quote treats misclassification. [9](https://asset.trvstatic.com/download/assets/epl-3001.pdf/2c354eaa63ca11eeacdd06e978c86228 "Employment Practices Liability Coverage (EPL-3001 Ed. 01-09, specimen)") [10](https://asset.trvstatic.com/download/assets/lia-3001.pdf/e79a6b6c63ca11eeaa7806e978c86228 "Liability Coverage Terms and Conditions (LIA-3001 Ed. 01-09, specimen)") [13](https://insurance.archgroup.com/wp-content/uploads/sites/2/ArchCanopy2_Playbook-1.pdf "Arch Corporate Canopy 2.0 playbook and policy form (PCD0700 00 07 22)")

### Does Employment Practices Liability Insurance Cover Employees of Startups Outside the United States?

It depends on the policy. One startup insurer's policy covers claims made and pursued in the United States, its territories, Puerto Rico or Canada, while a carrier's specimen terms apply anywhere in the world. Ask for the territory clause and list international employees on the application. [10](https://asset.trvstatic.com/download/assets/lia-3001.pdf/e79a6b6c63ca11eeaa7806e978c86228 "Liability Coverage Terms and Conditions (LIA-3001 Ed. 01-09, specimen)") [11](https://asset.trvstatic.com/download/assets/epl-n-14100.pdf/2d8b7a7c63ca11eeba389e98f6b6ed6a "Employment Practices Liability Coverage Application (EPL-N-14100 Ed. 06-22)") [14](https://www.corgi.insure/employment-practices-liability "Employment Practices Liability")
