## What Do Small Businesses Need From Cyber Insurance?

Check what you already hold before you shop. The NAIC says most commercial property and general liability policies do not cover cyber risks. Ask your agent in writing whether anything on your current policies responds to a data breach or a ransomware attack, and which part of the claim it pays. Cyber reaches small businesses by two routes that are not the same product. One agency says that, depending on the carrier, you can often fold cyber into a business owner's policy. One insurer says a BOP add-on such as Data Breach or Cyber Virus and Malware suits businesses with non-complex cyber risks, and sells a stand-alone policy to non-technology businesses with more complex ones, which it says triggers incident response actions immediately. Ask which route you are being quoted and what limit each one carries. Providers that sell to small businesses point to the customer data you handle and the card payments you accept, and one also names electronic-funds-transfer payments and notes that most small businesses do not have large IT resources dedicated to cybersecurity. The FTC says cybercriminals target companies of all sizes. These are providers' descriptions of who needs the cover, not a legal requirement. ## Which Cyber Exposures Do Small Businesses Face?

If you take card payments, the card brands' rules can become your loss. In a carrier's specimen cyber policy, the Security and Privacy section includes amounts payable on a PCI-DSS assessment in its definition of loss: a written demand from a card brand or acquiring bank for a monetary assessment, including a contractual fine, in connection with your non-compliance with PCI standards that resulted in a security failure or privacy event. The section excludes amounts you agree by contract to pay but carves PCI assessments out of that exclusion, and a separate endorsement in the specimen provides for a sublimit on them, with the amount left blank. Ask whether your quote names PCI assessments and what its sublimit is. A breach turns into notification work you may have no staff for. The FTC says all states, the District of Columbia, Puerto Rico and the Virgin Islands have laws requiring notice of security breaches involving personal information, and it suggests considering at least a year of free credit monitoring or similar support, particularly if financial information or Social Security numbers were exposed. The FTC's list of typical first-party coverage includes legal counsel on notification obligations and customer notification and call center services but does not mention credit monitoring, so ask whether your quote pays for it. Not every outage is an attack. One insurer lists an employee clicking a malware attachment and human error during a system upgrade that freezes the network among the events its cyber cover and optional add-ons may respond to, and a broker recommends buying early because ransomware attacks are rising even for small businesses. The FTC lists lost income from business interruption under typical first-party cover. Ask whether the policy's interruption trigger is limited to attacks or also reaches an outage you cause. ## What Should Small Businesses Check Before Buying Cyber Insurance?

Expect questions about your basic security habits and fix gaps before you apply. A small-business insurance agency lists multifactor authentication, backups, email controls, endpoint protection and vendor access as inputs carriers usually need, and another provider says some insurers are less likely to pay a claim if you do not take adequate prevention measures, such as training staff, maintaining a firewall and keeping virus protection up to date. Decide whether you need first-party cover, third-party cover or both, and ask who answers the phone. The FTC suggests discussing that choice with an agent, looking for "duty to defend" wording for lawsuits and regulatory investigations, and asking whether the insurer runs a breach hotline every day of the year. One insurer says it does not offer separate third-party cyber coverage and that such claims may fall within the general liability grant, so ask in writing where claims against you are covered. Compare the policy's definition of protected data with the data you hold. In a carrier's specimen, confidential information includes identifiers such as name, address, telephone and Social Security numbers and account numbers, information used to authenticate customers, and third parties' trade secrets and data in your care. Ask whether your quote's definition reaches everything you keep, such as employee records or a client's files, before a breach. It also says to notify law enforcement, affected businesses and affected individuals, and to check state and federal law for your requirements.
