## What Do Restaurants Need From a Business Owner's Policy?

Start with eligibility, not price. The Insurance Information Institute says some types of business, such as restaurants, may be ineligible for a business owner's policy because of the specific risks inherent in the business. Insurers still name restaurants: one lists restaurants and food service among the common industries for its BOP, and another says its BOP commonly fits restaurants. Ask each whether your concept and your alcohol sales fit. A lease can start the conversation. One insurer says a BOP comes up when you lease a storefront, salon, office or restaurant space and the landlord asks for liability limits or property coverage, and that carriers usually need the location's address, square footage, construction and occupancy, plus property, inventory and tenant improvement values, revenue and the liability limits you want. A restaurant tenant's buildout can be covered property in the ISO form if the declarations show a limit for business personal property. That category includes tenant's improvements and betterments: fixtures, alterations, installations or additions to a building you occupy but do not own, which you made at your expense and cannot legally remove. Appliances for refrigerating, cooking and dishwashing sit under Buildings only when you own them and use them to maintain or service the building or premises, so ask which limit your kitchen equipment falls under. ## Which Business Owner's Policy Exposures Do Restaurants Face?

Alcohol falls outside the liability section when serving it is your business. The ISO businessowners form excludes liability from causing or contributing to someone's intoxication, serving a minor or someone under the influence, or violating an alcohol sales law. Two insurers list liquor liability among the add-ons for their BOP. Refrigeration failure runs into the breakdown exclusion. In the ISO form, mechanical breakdown is an excluded cause of loss, and Equipment Breakdown Protection is an optional coverage that applies only if the declarations show it, for mechanical breakdown or electrical failure to pressure, mechanical or electrical machinery and equipment. One insurer describes its equipment breakdown add-on as covering electrical systems, air conditioning and refrigeration systems, mechanical equipment, boilers and pressure vessels, and computers, and says it can pay for the cost of food spoilage. Spoiled food is a separate question. The ISO businessowners specimen does not mention spoilage, and it excludes changes in temperature affecting personal property and utility failure that starts away from your premises. ISO's Spoilage Coverage endorsement, a commercial property form, covers only the causes its schedule lists: refrigeration breakdown at the premises, refrigerant contamination, or a power interruption beyond your control. One insurer adds that a restaurant industry endorsement might cover food spoilage. Illness closures sit outside business income. The Insurance Information Institute says business income coverage does not cover pandemics, viruses or communicable diseases, and one insurer's BOP brochure lists a Communicable Disease Exclusion among its mandatory forms. In the ISO form, business income also needs a suspension caused by direct physical loss of or damage to property at your premises. ## What Should Restaurants Check Before Buying a Business Owner's Policy?

Ask about alcohol first. Tell each insurer what share of sales comes from alcohol, then ask whether liquor liability is an add-on to the BOP, a separate policy or unavailable. If a BOP can't carry it, get a price for the pair together.
